FRESNO - The Fresno County District Attorney’s Office has charged Kingsburg City Council Member with driving a motor vehicle with a blood-alcohol level of .08 percent or higher, driving under the influence of alcohol, and speeding.

It is alleged that on June 21, 2021, at around 1:30 a.m., Hurtado was stopped by the California Highway Patrol for exceeding the speed limit. During the stop, officers noticed Hurtado to be exhibiting objective symptoms of being under the influence of alcohol. Hurtado was then arrested and cited to appear in the Fresno County Superior Court on October 15, 2021 to face driving under the influence charges.

In June the 22-year-old city council member that won her election by eight votes was named in a recall election notice with claims that Hurtado was supporting policies that had a "Marxist/Socialist" agenda. Her seat would be up for election again in November 2022. Hurtado stated that the recall effort was happening because she stood up for equal opportunity and justice for all. The recall effort gained momentum after it was revealed that Hurtado was arrested on suspicion of DUI.

The misdemeanor complaint alleges Hurtado committed the following offenses:

1. MISDEMEANOR DRIVING WITH A 08% OR HIGHER BLOOD ALCOHOL LEVEL [Vehicle
Code section 23152(b)]
2. MISDEMEANOR DRIVING UNDER THE INFLUENCE OF ALCOHOL [Vehicle Code section
23152(a)]
3. SPEEDING GREATER THAN 65 MPH [Vehicle Code section 22349(a)].

If convicted of all charges and allegations, Hurtado faces a maximum sentence of up to 6 months in jail. Hurtado is currently scheduled to be arraigned in the Fresno County Superior Court on October 15, 2021.
